Terms of Service

These Terms of Service are in effect as of Mar. 13th, 2024.

By ordering a commission from me, Pohvoro ("I, the Artist"), you ("the Client", "you, (s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist.Please note that these Terms of Service may be subject to change without prior notice.

Commission T.O.S

General

You cannot trace or copy any of my artwork.Do not upload my work to AI generators.You agree that my artwork and designs are NEVER to be used for NFTs. Do not use my work to promote and/or earn crypto currency.All commissions are personal, non-commercial/non-profit use only. Do not resell or use my art as merchandise unless stated otherwise.No refunds after the commission is finished.

payment

I only accept USD via Vgen, PayPal, or Stripe as payment.If you are paying in increments, the payment must be paid through an invoice in order for me to start the commission. I will not start the commission until the full payment is received.Request for refund is available during the sketch stage of the commission, after it is approved the option is off the table.

Revisions

Revisions will only be accepted during the sketch phase.
(Up to 3 Minor Revisions, Only 1 Major Revision)

Deadlines and Delivery

Waiting time may vary. However, actual turnaround will be up to 14 days.Kindly take note that I have multiple clients, and to ensure efficient service delivery, priority will be given to those who have completed payment first.If you wish to expedite the commission process, you may request to be placed on priority status. (minimum +50% of original price)

USE

You can use the commissioned work for personal use, streaming, and content creation, but you cannot use it to make money by producing merchandise or other commercial purposes without my permission. Commissioner has the right to re-upload their commission wherever as long as they credit me. Commissioner cannot claim the commissioned artwork as their own.

INTELLECTUAL PROPERTY RIGHTS

As the artist, I retain all intellectual property rights to the commissioned work. Clients are granted a non-exclusive, non-transferable license to use the commissioned work for personal use, streaming, and content creation only.It is strictly prohibited for clients to commercially use, reproduce, distribute, and/or modify the commissioned work without my prior written permission. I also retain the right to showcase commissioned work in my portfolio or on my social media platforms unless otherwise agreed upon with the client.YouTube/Twitch and Merchandise: A contract with be drafted depending on the circumstances we discussed.
Personal Accessories: It is permitted as long as the items are not used to sell commercially.

Refunds

Refunds will only be issued in the event of an error on my part. Please note that all sales are final.
